1. Acceptance of Terms

By accessing and using the Gaia Porto Stays website and services, you accept and agree to be bound by the terms and provisions of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services.

Any participation in our services will constitute acceptance of this agreement. If you do not agree to abide by the above, please do not use our services.

2. Booking and Reservation Policies

2.1. Booking Process

All bookings made through our website, email, or phone are subject to availability and confirmation. A booking is considered confirmed only after you receive a confirmation email from Gaia Porto Stays with a booking reference number.

2.2. Payment Terms

We require a valid credit card to secure your reservation. For certain rates or special offers, full or partial payment may be required at the time of booking. All payments are processed in Euros (€).

2.3. Cancellation Policy

Cancellation policies vary depending on the rate and dates of your stay. Please refer to the specific cancellation policy detailed in your booking confirmation. Generally:

• Cancellations made 48 hours or more before check-in will receive a full refund
• Cancellations made within 48 hours of check-in will be charged for the first night
• No-shows will be charged for the entire reservation

2.4. Modifications

Changes to your reservation are subject to availability and any rate differences. Modifications requested within 48 hours of arrival may be subject to additional fees.

3. Guest Responsibilities and Conduct

3.1. Check-in and Check-out

Check-in time is from 3:00 PM, and check-out time is by 11:00 AM. Early check-in and late check-out may be available upon request and are subject to availability and additional charges.

3.2. Age Restrictions

Guests must be at least 18 years old to book a room. Guests under 18 must be accompanied by an adult. Some room types may have additional age restrictions.

3.3. Behavior and Conduct

We expect all guests to respect the rights of other guests, staff, and property. Disruptive behavior, excessive noise, or any illegal activities will not be tolerated and may result in immediate termination of your stay without refund.

3.4. Damage to Property

Guests are responsible for any damage they cause to the property, fixtures, fittings, or equipment. We reserve the right to charge the credit card on file for any damages or extra cleaning required beyond normal wear and tear.

3.5. Personal Belongings

Gaia Porto Stays is not responsible for the loss, theft, or damage to personal belongings. Secure lockers are provided in dormitory rooms, and we recommend using them for valuable items.

4. Privacy and Data Protection

We are committed to protecting your privacy and personal information. Our Privacy Policy explains how we collect, use, and protect your data. By using our services, you consent to the collection and use of information as described in our Privacy Policy.

We may use your contact information to send you promotional materials or special offers. You can opt out of these communications at any time by following the unsubscribe instructions in the emails or by contacting us directly.

5. Intellectual Property

• The use or inability to use our services
• Unauthorized access to or alteration of your transmissions or data
• Statements or conduct of any third party on our services
• Any other matter relating to our services

Our total liability to you for all losses, damages, and causes of action (whether in contract, tort, or otherwise) shall not exceed the total amount paid by you to Gaia Porto Stays for the services in question.

7. Force Majeure

Gaia Porto Stays shall not be held responsible for any failure or delay in performing its obligations hereunder if such failure or delay is due to circumstances beyond its reasonable control, including without limitation acts of God, war, terrorism, government regulations, public health crises, natural disasters, or other emergencies.

In such circumstances, we will make reasonable efforts to notify you and may offer alternative arrangements or a refund at our discretion.

8. Governing Law and Jurisdiction

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of Portugal.

Any dispute arising from or relating to these Terms of Service or your use of our services shall be subject to the exclusive jurisdiction of the courts of Porto, Portugal.
